5. OUR LAWFUL BASES

Under UK data-protection law, we must have a lawful basis for processing personal information.

Depending on the circumstances, we rely on the following lawful bases.

5.1 LEGITIMATE INTERESTS

We may rely on your consent where required, including for certain non-essential cookies, local-storage technologies, analytics tools or advertising technologies.

Where we rely on consent, you may withdraw it at any time through the cookie-preference controls or by contacting us.

Withdrawing consent does not affect processing that occurred before consent was withdrawn.

5.3 LEGAL OBLIGATIONS

We may process personal information where necessary to comply with a legal or regulatory obligation.

5.4 LEGAL CLAIMS

We may process information where necessary to establish, exercise or defend legal claims.

6. CONTACT FORMS AND CORRESPONDENCE

When you contact us, we use the information you provide to:

• review your enquiry;

• respond to you;

• investigate a reported problem;

• consider a suggested correction;

• maintain a record of our correspondence; and

• protect our legal rights where necessary.

Contact-form submissions may be processed through Webflow and delivered to our business email account.

Our email and website providers may process message contents and related technical information on our behalf.

We do not add you to a marketing list merely because you contact us.

7. WEBSITE ANALYTICS

Everbound may use Webflow Analyze to understand how visitors use the website and how individual pages perform.

Webflow Analyze may process information such as:

• pages viewed;

• device type;

• referring source;

• general location information;

• website interactions; and

• aggregated browsing activity.

We use analytics information to:

• identify useful and underperforming pages;

• understand how visitors navigate Everbound;

• improve website design and content;

Everbound also uses Google Search Console to understand how its pages appear and perform in Google Search.

Search Console provides information such as search queries, impressions, clicks, indexing status and technical website issues.

Mapbox may receive information such as:

• your Internet Protocol address;

• browser and device information;

• map requests;

• map tiles or locations viewed;

• session identifiers; and

• technical usage information.

Everbound does not use Mapbox to request your precise GPS location unless this feature is expressly introduced and explained to you.

9. WEBSITE HOSTING AND CONTENT DELIVERY

9.1 WEBFLOW

Everbound is built and hosted using Webflow.

Webflow may process technical and usage information necessary to:

• deliver website pages;

9.3 DOMAIN REGISTRATION

Everbound’s domain is registered through GoDaddy.

GoDaddy does not ordinarily receive personal information about website visitors merely because it acts as the domain registrar.

We may add further information to this Privacy Policy if we begin using additional GoDaddy services that process visitor information.

10. AFFILIATE PARTNERS AND EXTERNAL TRAVEL PROVIDERS

At launch, Everbound may provide links to:

• Booking.com;

• Skyscanner; and

• Viator.

When you select an external provider link, you leave Everbound.

The relevant provider may independently collect information from you, use cookies or similar technologies, and process payment or booking information.

That provider acts under its own privacy policy and terms.

Everbound does not control how a third-party provider processes information after you leave our website.

Our partners or affiliate networks may use referral parameters, cookies or similar technologies to:

• identify that a visitor arrived from Everbound;

• attribute a booking or purchase;

• prevent fraud;

• calculate commission; and

• provide reporting.

Where these technologies are placed or accessed through Everbound and require consent, they should only operate after the relevant consent has been obtained.

Everbound may add or remove travel providers over time.

This Privacy Policy will be updated where a material change affects how personal information is processed.

11. PHOTOGRAPHS AND IMAGE PROVIDERS

Everbound may use photographs obtained under licence or permission from providers such as:

• Shutterstock;

• Pexels;

• Unsplash; and

• Pixabay.

Where images are stored and delivered through Everbound, Webflow or Cloudflare, the original image provider does not ordinarily receive information about visitors merely because the image appears on the website.

If Everbound directly embeds content from an external provider, that provider may receive technical information when the content loads.

We will update this Privacy Policy where such embedded services are introduced.

12. COOKIES, LOCAL STORAGE AND SIMILAR TECHNOLOGIES

Everbound may use cookies, local storage and similar technologies to:

• operate essential website features;

• remember consent choices;

• remember travel preferences;

• retain selected origins, destinations or filters;

• support website security;

• understand website usage;

• measure affiliate activity; and

• support advertising where introduced in the future.

Some technologies are necessary for the website to function.

Others are optional and may require your consent.

Where consent is required, optional technologies should not be activated until you have made an informed choice.

You can review or change your choices using the cookie-preference controls available on the website.

More information is available in our Cookie Policy.

13. ADVERTISING AND SOCIAL-MEDIA TRACKING

At the date of this Privacy Policy, Everbound does not use Meta Pixel, TikTok Pixel, Pinterest Tag or Google Ads remarketing to create personalised advertising audiences.

We may introduce advertising or conversion-measurement technologies in the future.

Before introducing them, we will:

• update this Privacy Policy where necessary;

• update the Cookie Policy;

• configure the cookie-consent system;

• provide appropriate information; and

• request consent where required.

This section does not authorise optional advertising technologies to be activated without appropriate privacy and consent controls.

• other parties where you have asked us or authorised us to share information.

We require service providers acting on our behalf to process information only for authorised purposes and to protect it appropriately.

We may disclose information where reasonably necessary to:

• comply with the law;

• respond to a lawful request;

• enforce our Terms of Use;

Everbound is based in the United Kingdom, but some of our service providers and travel partners operate internationally.

Your personal information may therefore be processed in countries outside the United Kingdom, including the United States and countries that may have different data-protection laws.

Where UK data-protection law requires safeguards for an international transfer, we will seek to rely on an appropriate mechanism, such as:

• a UK adequacy regulation;

• the UK International Data Transfer Agreement;

• the UK Addendum to approved standard contractual clauses;

• contractual and organisational safeguards; or

• another legally permitted transfer mechanism.

Some third-party providers may process information as independent controllers under their own transfer arrangements and privacy policies.

16. HOW LONG WE KEEP INFORMATION

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, security and dispute-resolution requirements.

Our anticipated retention periods include:

• ordinary contact enquiries and related correspondence: up to 24 months after the last meaningful communication;

• spam, irrelevant or malicious messages: deleted sooner where practicable;

• cookie-consent records: for as long as reasonably necessary to demonstrate and manage consent; and

We may retain information for longer where necessary to establish, exercise or defend legal claims.

We periodically review whether retained information is still needed.

17. HOW WE PROTECT INFORMATION

We use reasonable technical and organisational measures intended to protect personal information from:

• unauthorised access;

• accidental loss;

• misuse;

• alteration;

• disclosure; and

• destruction.

These measures may include:

• access controls;

• account authentication;

• encrypted connections;

• security monitoring;

• restricted administrative access;

• software and platform updates; and

• the use of reputable service providers.

No website, transmission method or storage system is completely secure.

We cannot guarantee absolute security.

18. YOUR DATA-PROTECTION RIGHTS

Depending on the law that applies to you, you may have rights in relation to your personal information.

Under UK data-protection law, these may include the right to:

• request access to your personal information;

• request correction of inaccurate or incomplete information;

• request deletion of your information in certain circumstances;

• request restriction of processing in certain circumstances;

• object to processing based on legitimate interests;

• receive certain information in a portable format;

• withdraw consent where processing is based on consent;

• object to direct marketing; and

• complain to a data-protection regulator.

These rights are not absolute and may be subject to legal conditions and exemptions.

To exercise a right, email jakob.novak@everbound.co.uk.

We may need to request information to verify your identity before acting on a request.

We will normally respond within the period required by applicable law.

19. COMPLAINTS

Please contact us first if you have concerns about how we use your personal information.

You also have the right to complain to the UK Information Commissioner’s Office.

The Information Commissioner’s Office is the United Kingdom’s independent data-protection regulator.

If you live outside the United Kingdom, you may also be entitled to complain to the data-protection authority in your country or region.

20. CHILDREN’S PRIVACY

Everbound is a general travel-planning website and is not directed specifically at children.

We do not knowingly collect personal information from children through user accounts, because Everbound does not currently provide user accounts.

A child should not submit personal information through the Contact page without the involvement of a parent or guardian where this is required by applicable law.

If you believe that a child has provided personal information inappropriately, contact us so that we can investigate and, where appropriate, delete it.

21. EXTERNAL WEBSITES

Everbound contains links to external websites.

This Privacy Policy does not apply to websites operated by Booking.com, Skyscanner, Viator or other third parties.

You should review the privacy policy of an external website before providing personal information or completing a booking.
